Privacy Policy

This Privacy Policy explains how Brand Wars LLC, doing business as Gnarly Host (“Gnarly Host,” “we,” “our,” or “us”) collects, uses, shares, and protects information when you visit gnarlyhost.com, request information from us, or use our software. We operate a software platform for short term rental operators and property managers. We are not a travel agency and we do not take guest reservations on our own behalf.

1. Information we collect

We collect the following categories of information:

Information you give us. Name, business name, email address, mobile phone number, number of properties, the property management software you use, and anything else you enter into a form, send us by email or text, or tell us on a call.
Account and usage information. If you create an account, we collect the information needed to operate it, including login credentials, subscription tier, properties you add, and records of your activity in the platform.
Automatically collected information. IP address, browser type, device type, pages viewed, and referring source, collected through cookies and similar technologies as described in section 7.

We do not purchase, rent, or otherwise acquire mobile phone numbers or contact lists from third parties.

2. How we use your information

To provide, operate, support, and improve our software.
To respond to your questions and requests, including by email, phone, and text message.
To schedule, confirm, and remind you about calls you book with us.
To send account, billing, and service notices.
To send you information about our products, features, and offers, where you have consented to receive it.
To meet legal, tax, and regulatory obligations.

3. How we share your information

We do not sell or rent your personal information. We share it only in these situations:

Service providers. Vendors who help us operate the business, such as hosting, email delivery, text message delivery, payment processing, scheduling, and analytics providers. They may use your information only to perform services for us and are bound by confidentiality obligations.
Legal requirements. When required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Gnarly Host, our customers, or the public.
Business transfer. In connection with a merger, acquisition, reorganization, or sale of assets, in which case the receiving party will be bound by this Policy or a policy at least as protective.

Mobile information and text messaging data

No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. All other categories of data exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Text messaging and consent

We send two kinds of text messages, and each has its own consent.

Marketing text messaging is optional and separate from every other agreement. Accepting our Terms of Service, creating an account, buying from us, or using our software never enrolls you in marketing text messages and is never treated as consent to receive them. Consent is collected only through a dedicated, unchecked checkbox, and declining it or withdrawing it later has no effect on your account, your pricing, or your access to any part of our services.

Marketing and promotional messages. These are sent only to people who have given express written consent through a form on our website that includes an unchecked consent checkbox dedicated solely to marketing messages, or by your written request. Checking the box is never required to submit a form, book a call, or buy anything. The disclosure presented at the checkbox reads:

By checking this box I agree to receive marketing and promotional text messages from Gnarly Host (Brand Wars LLC), such as product updates, new features, and offers. Message frequency varies, up to 10 messages per month. Message and data rates may apply. Reply HELP for help, STOP to cancel. Consent is not a condition of purchase, is not required to submit this form, and is not part of our Terms of Service or any other agreement. Program details are in our Privacy Policy and Terms of Service.

Booking messages. If you book a call with us and provide your mobile number, we send a confirmation and reminders for that call. These are transactional messages about a booking you requested, they are not marketing, and they are not sent under the marketing checkbox. The notice presented where you enter your number reads:

If you enter a mobile number, Gnarly Host will text you a confirmation and reminders for the call you book. These are booking messages, not marketing. Message and data rates may apply. Reply STOP to cancel them at any time.

The checkbox is never pre-checked and is completely separate from our Terms of Service and Privacy Policy. Agreeing to SMS is not part of any mandatory agreement. Checking it is not required to submit the form, to make a purchase, or to use our service. Consumers who leave it unchecked can still use every part of our website and service. They simply will not receive marketing texts, and declining or later revoking SMS consent has no effect on their ability to do business with us.

Replying STOP to any message stops texts from us, in both categories.

The full terms of the marketing program are:

Program name: Gnarly Host Alerts, operated by Brand Wars LLC, doing business as Gnarly Host.
Program number: Messages are sent from our toll free number, +1 888-885-7062. Save it so you know it is us.
What you receive: Marketing and promotional messages about Gnarly Host products, features, and offers.
What this program does not include: Confirmations and reminders for calls you book with us are booking messages, sent under their own notice shown at the time of booking. They are not part of this marketing program and do not require this checkbox. Replying STOP stops those as well.
Message frequency: Message frequency varies based on your activity, up to 10 messages per month.
Cost: Message and data rates may apply. These are charged by your mobile carrier, not by us.
How to get help: Reply HELP to any message, email [email protected], or call +1 888-885-7062.
How to opt out: Reply STOP to any message at any time. You will receive one confirmation message and no further messages after that. You may resubscribe at any time by replying START or by opting in again through our website.
Carrier liability: Mobile carriers are not liable for delayed or undelivered messages.
Consent is optional: Consent to receive text messages is not a condition of purchasing any product or service. The marketing consent checkbox is entirely separate from our Terms of Service and our Privacy Policy, and agreeing to receive text messages is not part of any mandatory agreement. Declining, or opting out later, has no effect on your account, your ability to buy from us, or your use of any part of our service.
Age requirement: You must be 18 years of age or older to use this SMS service. By opting in, you confirm that you are at least 18.

Opting out of text messages does not remove you from email communications, and does not affect your account or your ability to use our software. To stop email as well, use the unsubscribe link in any email or contact us at [email protected].

5. Email communications

When you provide your email address, you consent to receive transactional email relating to your account, your bookings with us, and your requests. Marketing email is sent only where permitted, and every marketing email includes an unsubscribe link that takes effect promptly.

6. Data retention

We keep personal information for as long as needed to provide our services and to meet legal, accounting, and reporting obligations. Text messaging consent records and opt out records are retained for as long as required to demonstrate compliance, even after you opt out.

7. Cookies and analytics

We use cookies and similar technologies to operate the site, remember preferences, and understand how the site is used. We use analytics and advertising measurement tools, including Google Analytics and Google Ads conversion tracking, which may set their own cookies. Most browsers let you refuse or delete cookies; some parts of the site may not function correctly if you do.

8. Data security

We maintain commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Your rights and choices

Request access to the personal information we hold about you.
Request correction of inaccurate information.
Request deletion of your information, subject to our legal and record keeping obligations.
Withdraw consent to marketing email or text messages at any time.
Depending on where you live, you may have additional rights under state or national privacy law. We honor those rights where they apply.

10. Children

Our services are for businesses and are not directed to anyone under 18. We do not knowingly collect personal information from children.

11. Third party links

Our site and software link to third party services, including property management software and payment processors. Their privacy practices are their own, and we encourage you to read their policies.

12. Changes to this Policy

We may update this Policy from time to time. The effective date at the top will change, and material changes will be communicated by email or by notice on the site.
